At the beginning of Our Declaration Of Independence, it states
Quoting Prop 12’s exact moment it revoked all Texan’s Right to life. “A person who in good faith administers emergency care,” “is not liable in civil damages” Texan’s Civil Rights subverted for medical profits. Logan’s Life was negligently taken and no one will be held accountable. Prop 12 overrides these unalienable rights of “Life”, in favor of Insurance Company Profits. Like Great Britain before it, The short history of Prop 12 “is a history of repeated injuries and usurpations.” Here it is in all its legalese. Prop 12 (HB 4). Reading through Chapter 74. Previously, “The Good Samaritan Law”, it is clear in Sec. 151. all instances that would leave any accountability, for Emergency Professionals earning their pay, are marked through. Good Samaritans are Heroes, not expecting reward or a paycheck, and should be protected from lawsuit. Doctors and EMTs earning their pay in their respective employment, must be held to some standard like any other professional. Prop12 say’s no mistakes or stupidity they commit matters. Emergency Professional’s immunity, OVERRIDING all Texan’s civil rights. http://www.legis.state.tx.us/tlodocs/78R/billtext/html/HB00004F.HTM
This article claims 40% of Texas Med Malpractice insurance is privately owned by Doctors, the TMLT“Texas Medical Liability Trust”. They were raising insurance rates on themselves. Shouting, complaining, and advertising the whole time about how high the rates are going because of frivolous lawsuits. Both the Doctor and their self owned Insurance Companies invested more than 11 million dollars, using scare tactics, to endorse, and sell us Prop 12 and eliminate lawsuits, thereby increasing profits on both sides. http://soc.hfac.uh.edu/artman/publish/article_288.shtml
After raising rates 147% on themselves, Pre-Prop 12, the TMLT/Doctors then give themselves a small 12% break after Prop 12 passed. Showing us how well Prop 12 is working. While their competitors, not owned by doctors, Med Pro and GE, said that they found that medical malpractice lawsuits did not have any bearing on raising the cost of insurance premiums, and that in fact, they were actually going to have to increase their rates All within 1 month after Prop 12 had passed. From the Insurance Economic Cycle chart below, it is obvious Texans were lied to. Premiums were more affected by the post 911 stock market, than by lawsuits that were declining, while rates increased. Although the rate climb slowed a bit after Prop 12 passed, is was soon back on track towards its upward journey. All prop 12 did here was remove accountability of Emergency Professionals. Leaving Texans completely at the mercy of sometimes, incompetent, negligent, indifferent, or drug impaired Emergency personnel. |
