As seen from some of the alterations to Prop shown 12 above. The Good Samaritan Law, was corrupted to include All Emergency Professionals, earning their pay. Giving Doctor Owned ,Malpractice Insurance Companies a free ride in Texas Emergency Room incompetence and negligence. The passage of the measure (Proposition 12) by 51 percent to 49 percent enshrines in the voluminous Texas Constitution a legislative limit of $750,000 per case on non economic claims for medical malpractice. Under this limit, a patient injured by faulty medical care can collect a maximum of $250,000 from a doctor and an additional $500,000 from one or more institutions. Gov. Rick Perry, who campaigned for passage of Proposition 12, called it “a very good night for the people of Texas.” Was Logan one of those Frivolous lawsuits, the doctors needed protection from? http://www.texmed.org/Template.aspx?id=2819 The opener on both articles should have read Insurance companies beat everyone. Barely 1.4 million voters decided this by the slimmest margin. It was a huge victory for the insurance companies, as it all but eliminated malpractice lawsuits. And the doctors temporarily saved a pittance of 12% on their malpractice insurance. It should have dropped a lot more. As the victims and families of their malpractice still must pay the medical bills from their own pockets. This was supposed to make health care better how? Doctors and Hospitals are untouchable now. Governor Perry, We all pray none of your children, or grandchildren ever has to go to a Texas Emergency Room. Putting your family through what we and many others continue to go through every day. More than that, we pray this was not the same type sponsorship as the anti-Ethanol campaign. Coincidently timed to another massive campaign donation from Pilgrim chicken farms. Or the Merck HPV vaccine mandate, after what seemed like a rather small donation from them. Because, it could appear that our Government, can be bought. And Texan’s Lives might have been sold out, in Prop 12, for insurance profits. Was Logan’s life sold to the highest contributor? The millions in campaign contributions taken from the Health sector. to strip away all Texan’s rights and protections from incompetent doctors, are blood money. Blood money, used to purchase absolute protection for negligently taking Logan’s and thousands of other lives. The word came from the lawyers. Since Proposition 12 tort reform limits the amounts that can be awarded, and gives Emergency Room Doctors, Complete Immunity. Justice for Logan, is too much work and too little profit for them to sue. Gambling for 30% of $500,000 dollars is not enough money to take the case. All the doctors consulting with the lawyers agree, this was absolutely negligence. 1/2 million dollars appears is the max that can currently be inflicted punitively on a hospital. That's possibly 1 day's income for a hospital of this size. Not even a slap on the wrist. This is the price placed on a wonderful child, who's life is taken by an incompetent emergency crew. 8 years ago a jury ordered this hospital to pay the family of Ricardo Romero $40 Million for "conscious indifference" in his severe brain damage that happened during surgery. The 14th Appeals court then overturned in 2003, 3 years later. The doctors, having tested positive for drugs, were however found liable, and settled with the family. Herein lies why lawyers don't want to take these cases. As long as people are hurt or ill, the hospital's funds are limitless. They can drag the appeals out for years. To the lawyers, a percentage of a measly $500,000 award is very unprofitable, if they win anything, after years of appeals. The silver lining to the hospital, and emergency team, not being called to account for their action? We won't be bound by any gag rules. All our efforts can and will go unrestricted into warning others about the hospital. And possibly effecting some change to Prop 12, so Lawyers will at least consider taking these legitimate cases. And in the future give the doctors and hospitals pause to consider at least the financial consequences of their actions, thereby saving lives. Right now, there is no accountability!
